The Subsistence Minimum Protection

Under the Debt Collection Act (SchKG Art. 93), only income above the legally calculated subsistence minimum can be garnished. The subsistence minimum includes: rent, food, clothing, health insurance premiums, taxes, public transport to work, child support obligations. The cantonal debt collection office calculates the exact amount based on your personal circumstances. If your income does not exceed the minimum, nothing can be garnished, the seizure order (Pfändungsurkunde) records CHF 0.

The Garnishment Process

Process: (1) Creditor files debt collection request (Betreibungsbegehren) with the debt collection office. (2) Payment order (Zahlungsbefehl) is served, you have 10 days to raise an objection (Rechtsvorschlag). (3) If the creditor obtains a court order lifting your objection, the debt collection office issues a wage garnishment order to your employer. (4) Your employer is legally required to remit the garnishable portion directly to the debt collection office each month. Failure to comply is a criminal offence.

Duration, Employment and Tax

Wage garnishment lasts a maximum of one year (SchKG Art. 116). After one year, the creditor must restart the process. Employers cannot dismiss an employee because of wage garnishment, such dismissal is wrongful (SchKG Art. 93/4 and OR 336). Garnished income is still fully taxable income, the amount you receive (net of garnishment) is reported on your wage certificate. If you manage to pay the full debt before one year, the garnishment stops immediately.
