How the calculation works
In Switzerland, the legal notice period is set by Article 335c of the Code of Obligations. The fundamental rule is that the period runs from the end of the calendar month in which notice was given. Notice given on 5 March with a 2-month period takes effect on 31 May (end of March + 2 months = end of May). Notice given on 30 March also takes effect on 31 May.
Exception: during the probation period, the 7-day notice runs from the day of notification, without waiting for the end of the calendar month.
Legal periods are minimums. The employment contract or an applicable collective bargaining agreement (CBA) may provide for longer periods. A contractual period shorter than the legal minimum is void — the legal minimum applies in that case.
Special cases to know
The notice period is automatically suspended during legal protection periods: illness or accident (duration varies by seniority: 30 days in year 1, 90 days from year 2–5, 180 days from year 6), pregnancy and 16 weeks after delivery, military or civilian service. Notice given during a protection period is void. These situations often lead to disputes: consulting a lawyer is recommended in cases of uncertainty.
